Welcome to Nury. These Terms of Service ("Terms") govern your access to and use of nury.love, any related websites, online stores, checkout pages, content, products, services, emails, social media features, and other services that link to these Terms (collectively, the "Site").

The Site is operated by Nury LLC ("Nury," "we," "us," or "our"). By accessing the Site, placing an order, creating an account, submitting content, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site or purchase products from us.

1. Eligibility

You must be at least the age of majority in your state or province of residence, or have the consent of a parent or legal guardian, to use the Site or purchase products. By using the Site, you represent that you have the legal capacity to enter into these Terms.

2. Our Products

Nury sells canvas bucket hats, fashion accessories, and related products bearing the Nury name, heart mark, designs, or other brand elements.

Product descriptions, photographs, colors, dimensions, and availability are provided for general informational purposes. We try to display our products accurately, but we do not guarantee that your device will display colors, textures, scale, or details exactly. Some products may include natural, distressed, washed, frayed, embroidered, stitched, printed, hand-finished, or small-batch characteristics. Minor variations in color, fabric, embroidery, stitching, mark placement, brim shape, distressing, or finish are not necessarily defects.

3. Orders and Acceptance

When you place an order, you are making an offer to purchase the items in your cart. We may accept, decline, cancel, or limit any order for any lawful reason, including product unavailability, suspected fraud, pricing or typographical errors, shipping restrictions, payment issues, inventory errors, unusually large quantities, or misuse of promotions.

Your receipt of an order confirmation does not mean that we have accepted your order. We accept your order when we process payment and/or ship the product, subject to our right to cancel or refund as described in these Terms.

4. Pricing, Promotions, and Availability

Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, product availability, discounts, and shipping offers may change at any time without notice. We reserve the right to correct errors, inaccuracies, or omissions, including after an order has been submitted. If we cancel an order after payment due to an error or unavailability, we will issue a refund for the canceled item.

Promotions, discount codes, gift cards, store credits, or special offers may be subject to additional terms, expiration dates, product exclusions, or usage limits. We may modify or discontinue promotions at any time.

5. Payment

You agree to provide current, complete, and accurate billing, shipping, and payment information. Payment may be processed by third-party payment providers. We do not directly store full payment card numbers where a third-party payment processor handles the transaction. By submitting payment information, you authorize us and our payment processors to charge the applicable amount, including taxes, shipping, and other fees shown at checkout.

6. Taxes

You are responsible for any applicable sales, use, import, customs, VAT, GST, or similar taxes, duties, or fees associated with your order. For orders shipped to jurisdictions where we are required to collect tax, applicable taxes will be shown at checkout or otherwise added to the order.

7. Shipping and Delivery

Shipping is governed by our Shipping Policy, which is incorporated into these Terms. Delivery dates are estimates, not guarantees, unless expressly stated otherwise. We are not responsible for carrier delays, weather events, incorrect addresses, customs delays, theft after delivery, or other events outside our reasonable control.

Risk of loss and title for physical products pass to you when the products are delivered to the shipping address you provided, unless applicable law requires otherwise.

If we cannot ship within the stated timeframe, we may contact you with a revised shipment estimate and your available options, which may include waiting for the delayed shipment or receiving a refund for the unshipped item.

8. Returns and Exchanges

Returns and exchanges are governed by our Returns & Exchanges Policy, which is incorporated into these Terms.

Unless otherwise stated in that policy, returned hats must be unworn, unwashed, unused, undamaged, free of stains, makeup, fragrance, hair products, deodorant, smoke, pet hair, or odor, with tags and original packaging intact. Items marked final sale, gift cards, and customized or personalized products may not be returnable unless defective or required by law.

9. Product Care and Use

You are responsible for reading and following product labels, care instructions, and any instructions provided with the product. Nury is not responsible for damage caused by improper washing, drying, ironing, steaming, storage, reshaping, exposure to heat, chemicals, hair products, cosmetics, bleach, dye transfer, excessive moisture, or misuse.

Our products are fashion accessories. They are not designed or represented as protective headgear, safety equipment, medical products, sun-protection devices, or occupational gear.

10. Accounts

If the Site allows account creation, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

We may suspend or terminate accounts for suspected fraud, misuse, violation of these Terms, or other lawful reasons.

11. Intellectual Property

The Site and its content, including the Nury name, heart mark, logos, designs, product names, photographs, graphics, text, layout, look and feel, videos, product descriptions, and other materials, are owned by or licensed to Nury and are protected by trademark, copyright, trade dress, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, display, sell, resell, exploit, scrape, frame, mirror, imitate, or use any Nury content, design, mark, or product imagery for commercial purposes without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in or to the Nury name, heart mark, logos, designs, or other intellectual property.

12. User Content, Reviews, and Social Media

If you submit, post, tag, upload, send, or otherwise provide content to us or about us, including reviews, photos, videos, comments, feedback, testimonials, social media posts, or other materials ("User Content"), you represent that you own or have the rights to provide that content and that the content is truthful, lawful, and does not infringe anyone else's rights.

By submitting User Content directly to us or tagging us in publicly available content, you grant Nury a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, display, distribute, repost, edit, crop, adapt, and otherwise use the User Content in connection with our business, marketing, advertising, social media, website, email, and promotional activities, subject to applicable law and platform terms.

We may remove, reject, or decline to use User Content at any time. We do not guarantee that User Content will be displayed.

You may not submit fake reviews, reviews written by someone who did not actually use or purchase the product, reviews created by artificial intelligence but presented as real customer experiences, or reviews that contain false, misleading, defamatory, infringing, obscene, harassing, or unlawful content.

If you received a free product, discount, payment, commission, affiliate benefit, or other material connection from Nury, you must clearly disclose that connection in any review, endorsement, post, or testimonial as required by law and platform rules.

13. Prohibited Conduct

You agree not to:

• Use the Site for unlawful, fraudulent, deceptive, abusive, or harmful purposes
• Interfere with the Site's operation, security, servers, networks, checkout, or payment systems
• Use bots, scrapers, crawlers, automation, or data extraction tools without our prior written permission
• Attempt to gain unauthorized access to accounts, systems, or data
• Submit false, misleading, infringing, defamatory, or unlawful content
• Impersonate another person or entity
• Misuse promotions, discounts, referrals, returns, chargebacks, or customer support
• Purchase products for unauthorized resale or commercial exploitation without our written permission
• Violate any applicable laws, regulations, or third-party rights

14. Third-Party Services and Links

The Site may use or link to third-party services, including ecommerce platforms, payment processors, shipping carriers, analytics providers, advertising platforms, review tools, email providers, social media platforms, or other services. We are not responsible for third-party websites, services, policies, practices, content, or availability. Your use of third-party services may be governed by their own terms and privacy policies.

15. No Warranties

To the maximum extent permitted by law, the Site and products are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.

Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.

16. Limitation of Liability

To the maximum extent permitted by law, Nury LLC and its owners, members, managers, officers, employees, contractors, service providers, suppliers, licensors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, or business opportunity, arising out of or related to your use of the Site or purchase or use of products.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to these Terms, the Site, or any product will not exceed the amount you paid to Nury for the product or order giving rise to the claim.

Nothing in these Terms limits liability where prohibited by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless Nury LLC and its owners, members, managers, officers, employees, contractors, service providers, suppliers, licensors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, misuse of the Site, violation of law, infringement of third-party rights, or User Content.

18. Governing Law

These Terms and any dispute arising out of or related to the Site or products are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

19. Dispute Resolution

Before filing a claim, you agree to contact us at hello@nury.love and provide a reasonable opportunity to resolve the dispute informally.

Any dispute arising out of or related to these Terms, the Site, or products shall be resolved by binding arbitration administered by [AAA/JAMS] in [San Mateo County, California], except that either party may bring an individual claim in small claims court or seek injunctive relief for intellectual property misuse. You and Nury waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action, except where such waiver is prohibited by law.

20. Termination

We may suspend or terminate your access to the Site, cancel orders, refuse service, or remove content if we believe you violated these Terms, misused the Site, engaged in fraud, or created risk for Nury or others.

21. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms, to the extent permitted by law.
